A recent decision from the Ontario Court of Justice clarifies the rules when a fiduciary jumps ship. The case, Aquafor Beech Ltd. v. Whyte was decided on May 14, 2010 and involved a claim by a company against a number of professional engineers who resigned. The case involved whether there was a breach of fiduciary duties.
